Deposit Agreement

I, the Tenant, have hereby placed a $400 deposit on the apartment at the above address, and under the above terms. I understand and acknowledge that, unless the Landlord or Management Company denies my application, the deposit is non-refundable. I understand that if my application is not approved, I will receive a full refund on the deposit, but not the $200 application fees. I understand that the application fees are non-refundable. I understand that if at any point of the process I am no longer interested in moving into the apartment, or if I fail to submit the documents stated on the rental application, it will constitute a waiver of my deposit. I further acknowledge that I have received from Roomeze a list of all the necessary documents and fees that I need to complete my application.I further acknowledge that I have received from the broker/agent a list of all the necessary documents and fees that I need to complete my application. I also understand that failure to submit the any application fees and the remaining documents within 48 hours will constitute as a waiver of my deposit. Additionally, I acknowledge that I understand that unless otherwise stated, no utilities are included in the rent. I understand and acknowledge that Roomeze does not keep my deposit, or any money I have paid, other than the $200 application fee. I understand that my deposit is paid forward to the Management, and becomes my security/damage deposit on the apartment, which I may request back from the Management upon vacating the apartment. I agree that, after I move in, I will not seek a refund of my deposit from Roomeze, I will make any financial inquiries with my new Management.


Disclaimers and Release of Liability

I understand and acknowledge that, to the fullest extent permitted by applicable law and, except as expressly provided in these Terms, the Site and all content, products and services provided through it are provided on an "as is" basis. Roomeze does not make any representation or warranty of any kind, either express or implied (whether by common law, custom, statute or otherwise), in relation to the Site or any content, products and services provided through it including, without limitation, any warranties in relation to fitness for a particular purpose or in relation to the quality, completeness, accuracy or reliability of the Site and all content, products and services provided through it.

Without limiting the generality of the foregoing, I acknowledge and agree that any rooms, apartments, houses, properties or tenancy arrangements are provided by our members and not by us. Roomeze has no control over, nor accept any responsibility or liability for, any such arrangements or issues I may encounter with them.

Roomeze does not inspect any of the properties or rooms that feature in adverts on our Site, and I understand that Roomeze strongly advises all potential Tenants to inspect properties thoroughly before making any binding commitments in respect of any properties or rooms listed on the Site.

The information made available on the Site, whether posted by us or by any other users, is provided for information purposes only. Roomeze cannot guarantee that any adverts or other information provided on the Site will be correct, accurate, up to date or meet my needs or requirements. The information provided on the Site is not intended to be professional or legal advice of any kind and should not be relied on as such. I take full responsibility, and understand the risk, for any reliance I place on any materials or information made available on the Site.

I understand and acknowledge that, though Roomeze does the utmost to ensure a reliable service, it does not guarantee that the Site will always be available or error free, that defects will be corrected, or that the Site or the server that makes it available are or will be always free of viruses or other harmful components.

I understand that final approval is given by the landlord or management company, not by Roomeze, and that Roomeze is not able to reverse that decision. I understand that New York law does not allow leases for individual rooms, and that I, along with any other tenants, cosigners, or guarantors, are jointly and severally responsible for the obligations of any lease I sign.

I understand that some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to me. It is my responsibility to check the local laws of the jurisdiction in which I am a resident to determine the extent to which any implied warranties may be relevant to our legal relationship with you.

Nothing in these Terms is intended to disclaim or exclude any warranty or liability that cannot be disclaimed or excluded by operation of applicable law.

I agree that Roomeze shall not be liable for: (a) any indirect loss, claim or damage, or any punitive, special, incidental or consequential damages of any kind; or (b) any direct or indirect loss of profit, anticipated savings, opportunity or business and loss, corruption or damage to data, in each case whether based in contract, tort (including negligence), strict liability, or otherwise, which arises out of or is in any way connected with: (i) any use of this Site or the services provided through it; (ii) any failure or delay in the use of any component of the Site or any service including, without limitation, any unavailability of the Site or the services provided through it irrespective of the duration of any period of unavailability; (iii) any use of or reliance upon any adverts, information, material, or other products or services offered through the Site, in all cases even if Roomeze has been forewarned of the possibility of such loss or damage; and (iv) any tenancy or lodging arrangements of any kind that you enter into as a result of using our Site.

Roomeze total aggregate liability to you under these Terms whether based in contract, tort (including negligence), strict liability, or otherwise shall be limited to direct losses not to exceed the total payments you have made to us for services offered to you through the Site in the 12 months preceding my claim.


Roomeze Support

When requested by one or more roommate(s) in an apartment, Roomeze will attempt to mediate and resolve any issues between two or more roommates, or between roommates and management. Though Roomeze will make a good faith effort to remedy any problem, Roomeze Support does not guarantee any resolution. I understand that Roomeze, including Roomeze Support, does not have the power to alter my lease in any way, or evict any roommates from my apartment.

Roomeze Swap refers to the service in which Roomeze will facilitate moving a tenant between two roomeze apartments, or in certain circumstances, allows them to entirely vacate their apartment. I acknowledge that once activated the Roomeze Swap plan does not guarantee immediate move out and that my move out is conditional on finding a replacement for my current room. I also acknowledge that it is not possible to void my lease without the cooperation of my landlord, and Roomeze is only an intermediary between the parties to the lease. I understand that I must continue to abide by all terms of my lease, including those related to vacating the apartment until I am released from the contract. Furthermore, I am aware that as part of Roomeze Swap I am required to either 1: choose another apartment through Roomeze, and that this will require me to sign onto a new lease, or 2: forfeit my security deposit. I acknowledge that it is my responsibility to leave the room and the apartment in the condition in which I moved in. Any damage to room or apartment will be withdrawn from my security deposit before I am allowed to move. If the damage caused exceeds the amount of my security deposit, I will be responsible to pay the balance before I am allowed to move. If I choose to forfeit my security deposit, and not move into another Roomeze apartment, I will be required to pay for the damages out of pocket before I am allowed to move, because the security deposit was already forfeited. Roomeze is in no way responsible for any of the costs associated with my move. Violating the terms of your lease will void this agreement. Landlord move in requirements vary by apartment, and you must meet the requirements for the new apartment to move in. This policy only covers you as an individual, and can not be used to find you a room with a partner or pet you did not have at the time of signing. We cannot guarantee that there will be a room available with the exact same size and price as the one you originally took.

Roomeze will help facilitate the renewal of your lease, or vacating your apartment at the end of your lease. I understand that only my landlord can allow me to renew my lease, and that Roomeze does not have the power to create, alter, or renew a lease. Furthermore, if I intend on renewing my lease, I agree to notify Roomeze at least 30 days prior to the expiration of the lease. If I am vacating my room at the end of my lease, I agree to provide Roomeze with access to show my room to potential replacement tenants, and keep the room in a presentable condition. In all cases, I agree not to do anything to prevent Roomeze from refilling the room, including but not limited to preventing access to the apartment, informing a potential tenant that they may not move into the apartment, or failing to keep the apartment in an unpresentable or unsafe condition. I understand that failure to so may lead to forfeiture of my security deposit. I understand that if qualified replacements are not found by the end of the lease, for whatever reason, I will either have to vacate the apartment, or cover the balance of the entire rent.


Transfer of Application Information

Some of the Management with which we work have, and require us to use, their own application processes. For my convenience, I agree to allow Roomeze to fill out these secondary applications on my behalf, using information I submit through Roomeze. I acknowledge that, if I would like to fill out these secondary applications myself, I will inform Roomeze in writing before I submit my application.


On-site

Some of our Management companies process applications through On-Site, a third party property management service. Those applicants are subject to the following terms. Roomeze will indicate if my application is being processed through On-Site upon written request. Though this language comes directly from On-Site, some of these rights and terms apply to all of our apartments and Management. I understand and agree to the following.

All of our Management companies operate in accordance with the Federal Fair Housing Act, as well as all state and local fair housing and civil rights laws. We do not discriminate against any person based on race, color, religion, gender, national origin, age, sex, familial status, handicap, disability, veteran status, or any other basis protected by applicable state or local laws. The Rental Criteria below outlines some of the policies for this community with regard to standards that may be required by each applicant in order to be approved for residency.

All applicants must be of legal age. All parties 18 years of age or older are required to complete an application and pay any and all applicable fees. Applications are to be completed in full; applications containing untrue, incorrect, or misleading information will be denied. The application fee is non-refundable unless otherwise provided by state or local law.

ALL applicants are REQUIRED to show at least one of any of the following forms of identification: Government issued identification such as military identification, driver's license or passport, age of majority card, birth certificate, or social security card

All applications are submitted to On-Site.com, a third-party rental applicant screening company. All applications are evaluated based on a rental scoring system. Rental scoring is based on real data and statistical data such as payment history, quantity and type of accounts, outstanding debt, and age of accounts. Every applicant is treated objectively because each application is scored statistically in exactly the same manner.

The rental scoring system will compare your application to On-Site's database, and by evaluating those statistics and real data in accordance with pre-established criteria set by Management, On-Site will recommend one of the following: Accepted--the applicant will be accepted with the standard deposits and fees, Accepted with Conditions--depending on the community's policy, the applicant may be given the option to pay an additional security deposit, Denied--the application will not be accepted. The applicant will be provided with contact information for the consumer reporting agencies that provided the consumer information. If On-Site recommends "Accepted with Conditions" or "Denial," a guarantor or co-signer may be considered. In this instance, the original applicant's application will be re-submitted along with the guarantor or co-signer's application. Applications for guarantors and co-signers processed through On-Site are also scored, but are typically held to a more stringent, pre-established screening standard because guarantors and co-signers are technically responsible for the payments for this residence, as well as their own place of residence.

Written verification of income in an amount equal to 40.0 times the monthly rent per household will be required, along with any necessary supporting documents.

Management reserves the right to verify the applicant's residence history. Applicants charged convicted for certain felony and misdemeanor offenses may not be approved for residency, depending upon the pre-established criteria set by Management. Applicants who have been a party to an eviction proceeding may not be approved for residency, depending upon the pre-established criteria set by Management.

If your application is denied due to unfavorable information received on your screening report you may: contact On-Site to discuss your application and identify any unfavorable information, supply On-Site with proof of any incorrect or incomplete information, or request that On-Site re-evaluate and re-report your screening information and rental score to Management.

Your rental score results from information found in your credit report, criminal history, references, and application data. Such information may include your history of paying bills and rent, the accounts you have, collections and delinquencies, income and debt.

Your rental score may change if the underlying information it is based upon changes. To improve your score, concentrate on paying your bills on time, paying down outstanding balances, and removing incorrect information. Your chances of approval may also improve if you apply for an apartment with lower monthly rent, or use a guarantor or co-signer if permitted by Management.

NEW YORK CITY TENANT FAIR CHANCE ACT

Pursuant to federal and state law NYC Admin. Code ยง20-807 et seq.:

1) If your application is denied or other adverse action is taken against you due to a screening report the Management uses, the Management must tell you so and how to contact the screening company to obtain a free copy of the report.

2) You may dispute inaccurate or incorrect information on the report directly with the screening company.

I hereby apply to lease a residential unit and agree that rent is due the 1st day of each month in advance. I warrant that all statements above set forth are true.

I hereby give my permission to communicate with my current and former landlord or property manager for the purpose of discussing any and all of the facts and circumstances of my current or former tenancy, as well as the other information listed above. I also give my permission to communicate with my current employer(s) and/or supervisor(s) for the purpose of verifying the employment information listed above. I understand there are no limitations or restrictions regarding what may be discussed or revealed. I am aware that a credit history, eviction search and criminal background check will be done in conjunction with my application, and I hereby authorize Roomeze, On-site, and/or Building Management to request a copy of my credit report, and verify my references and credit as they relate to my tenancy and future rent collections. I understand that I may have the right to make a written request within a reasonable period of time to receive additional, detailed information about the nature and scope of this investigation. By submitting this application, I hereby consent to the delivery of all notices or disclosures required by law via any medium so chosen by the community or Roomeze, including but not limited to email or other electronic transmission. Notices shall be deemed received upon being sent.

I hereby warrant that all statements set forth in my application are true. I understand that a consumer report and/or an investigative consumer report may be requested in connection with my prospective or continuing housing and/or employment application with the above the Management of the above apartment through Roomeze. I understand that these reports may include information concerning my character, employment history, general reputation, personal characteristics, public records information, criminal records information, education, qualifications, motor vehicle record, mode of living, credit and indebtedness information, and any other information which may reflect upon my potential for tenancy or employment gathered from any individual, organization, entity, agency, or other source which may have knowledge concerning any such items of information.

I understand that I have the right to make a written request, within a reasonable period of time, for complete and accurate disclosure of the nature and scope of the investigation requested. I understand that I have the right, upon submitting proper identification, to request from Roomeze the nature and substance of the information in the consumer report or investigative consumer report, including the sources of information and the recipients of any reports on myself, which Roomeze has previously obtained about me within a two-year period preceding my request. I consent to the delivery of all notices or disclosures required by law via any medium so chosen by the Management of the above apartment or Roomeze, including but not limited to email or other electronic transmission. I understand that all notices shall be deemed received upon being sent.

By submitting this application, I certify that I have read and fully understand the disclosures and my rights detailed above and authorize On-Site to obtain, for the purpose of determining my eligibility for initial or continued tenancy, and/or employment a consumer report and/or investigative consumer report and to disclose all information obtained by On-Site to the Management of the above apartment, its affiliates, and assigns now and in the future. By submitting this application, I acknowledge that I would like to receive a copy of my consumer report and/or investigative consumer report.

I understand that, upon written request, I will be informed whether or not a consumer report or an investigative consumer report was requested and, if such a report was requested, informed of the name and address of the credit reporting agency that furnished the report. With regard to "investigative consumer reports," I further understand that when I receive the name and address of the consumer reporting agency, I may request a copy of such report by contacting such agency.
